You must get an exact opinion letter of your home’s value from a local real estate broker or agent. It is usually free or inexpensive. Real estate appraisals are also accepted. Lawsuits by themselves are okay. But, if your lawsuit has also gone to JUDGMENT, then you may have a judgment lien on your house. Such judgment liens (judicial liens) will not automatically go away when you file for bankruptcy. It will still stay attached to your house and must be paid at some later time. SOMETIMES such liens can be removed during your Chapter 7 or Chapter 13 case by filing a Motion to Avoid Judicial Lien during the case. This removal action is not automatic and requires your approval and a $75 fee per lien according to our contract.
